DC SCORES 50/50 Raffle

Official Rules

DC SCORES, a tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code, located at 1140 Connecticut Avenue NW, Suite 1200, Washington, DC, 20036, (the “Charity”) is conducting this raffle pursuant to D.C. Municipal Regulations Title 30, § 1509, to raise funds for ongoing charitable purposes. By purchasing a raffle ticket, the purchaser agrees to be bound by these official rules. DC SCORES’ interpretation and application of the rules shall be final and binding.

Official Rules. DC SCORES will conduct a 50/50 Raffle (each, a Raffle) at Audi Field, located at 100 Potomac Avenue SW, Washington, DC, 20024, and online during certain preseason, regular-season and postseason home games of D.C. United. Only one Raffle will be held during any particular game. By participating in a Raffle, entrants agree to be bound by these Official Rules and by the decisions of the DC SCORES, which shall be binding and final as to all matters related to the Raffle. Each Raffle is subject to all applicable federal, state and local laws and is void where prohibited.

Eligibility. Each Raffle is open to all persons age 18 and older who are located in the District of Columbia at the time of purchase and subject to these Official Rules. Employees, officers, and board members of the Charity, 50/50 Raffle staff and ticket sellers, and the immediate families and members of the same household of the foregoing are not eligible.

Purchasing Tickets. The Raffle is open to all persons who are located in the District of Columbia at the time of purchase. Ticket purchasers must be 18 years of age or older. On any date that a Raffle is occurring, Raffle tickets (“Tickets”) will be sold in person at D.C. United Games and online at https://www.dcscores.org/5050 from noon on the day of the match until the 70th minute of the match, or as otherwise determined by the Charity in its discretion. Tickets may be purchased as follows: 10 for $10, 40 for $20, 100 for $40, or 300 for $100. Tickets must be purchased with a credit card in U.S. dollars. There is no limit to the number of Tickets an individual may purchase; provided, however, that if the amount of a Prize reaches $150,000, no additional Tickets will be offered for sale. Each entrant will receive a receipt corresponding to his/her purchase. The Charity is not responsible for printing errors in any Raffle-related material or any misdirected, incomplete, lost, late or illegible Tickets or other errors or problems which may limit an entrant’s ability to participate in or win a Raffle. All Ticket purchases shall be final, and no refunds or replacements will be issued by the Charity. Tickets are only valid for the drawing held on the date of purchase.

Raffle Tickets are Not Tax Deductible. The IRS has taken the position that amounts paid for chances to participate in raffles, lotteries or similar programs are not gifts and, therefore, the price of the entry does not qualify as a deductible charitable contribution.

The Prizes. At every match, one (1) single Final Jackpot Prize ("Jackpot") will be drawn at the 70th minute of the match. The Jackpot prize will be determined as half of the amount of the gross proceeds from the sale of Tickets to each Raffle (as determined by the Charity in its sole discretion) shall constitute the Raffle's Jackpot Prize. The other half shall be retained by the Charity for the benefit of DC SCORES, a registered 501(c)(3) charitable organization. $75,000 is the maximum amount of any Jackpot. At select matches, two (2) prizes will be awarded during the course of a single Raffle. One (1) single Early Bird Prize ("Early Bird") will be drawn before the start of the second half for each Raffle. Early Bird Prizes can include but are not limited to branded items, signed memorabilia, game tickets, concert tickets, experiences, and other possible prizes. In no event shall the Early Bird be comprised of or otherwise include a cash prize.

Selection of the Winning Ticket. At the 70th minute of the match, one Ticket will be randomly drawn utilizing automated software to determine the winner of the Jackpot. The holder of the winning Ticket does not need to be present at the time of the drawing in order to win. The winning Ticket will be announced at Audi Field at the 85th minute of the match and listed on the Charity’s webpage at https://www.dcscores.org/5050. At select matches with an Early Bird Prize, following halftime (or the announcement of any postponement or cancellation of the match), one Ticket will be randomly drawn utilizing automated software to determine the winner of the Early Bird. The holder of the winning Early Bird Ticket does not need to be present at the time of the drawing in order to win. The winning Early Bird Ticket will be announced at Audi Field at the 85th minute (or within fifteen minutes following any postponement or cancellation announcement) and listed on the Charity’s webpage (https://www.dcscores.org/5050). Eligible Tickets held by the Early Bird winner are still eligible to be drawn for the Jackpot.

Taxes. Each winner shall be responsible for any and all federal, state and local income or excise taxes, fees, assessments and like charges associated with a Prize. At the time of this printing, federal law requires that tax withholding on certain prize values must be collected from winners upon award and distribution. Federal, state and local withholding laws are subject to change without notice. The withholding laws in effect at the time each Prize is claimed will be followed.

Claiming a Prize. Within 90 calendar days of a drawing, the holder of the winning Ticket in any Raffle must do the following: (1) present the winning Ticket; (2) complete and sign the Affidavit, Prize Claim and Release (“Release”); and (3) complete and sign all applicable tax forms. Ticket holders may complete these steps by contacting DC SCORES at 5050@dcscores.org or 2023936999. Once those steps have been timely completed, the Charity will mail a check, within 30 days, to the winner identified on the Release at the address identified on the Release. The amount of the check will equal the amount of the Prize less any applicable tax withholding (as described in the Taxes Section above). In the event that the holder of the winning Ticket: (a) does not complete steps (1) through (3) above; (b) is ruled ineligible for any reason; or (c) refuses the Prize, the Prize will be forfeited and will be retained by the Charity for charitable use. In the unlikely event that an error or problem in the administration of a Raffle results in more than one Ticket purchaser holding a Ticket that has the winning number, the person holding the Ticket that was purchased the earliest shall be deemed to hold the winning Ticket. A Ticket is void and its holder is ineligible to win the Prize if there is sufficient evidence, in the sole discretion of the Charity, that the Ticket was improperly issued, printed in error, counterfeited, stolen, illegible, altered or subject to other deficiencies, and the Charity will have no liability with respect to any such Ticket.

Transfer and Resale of Tickets.   In the event of a dispute, the Charity shall conclusively presume that the person whose name is associated with the online purchase of the winning Ticket, or absent such a record, the person who is in possession of the Ticket, is the lawful owner of that Ticket and that Ticket’s winning number. The Charity shall not make, nor have any duty to make, any inquiry whatsoever into the circumstances under which the person holding the winning Ticket came into possession of it. Purchasers of Tickets may not re-sell or transfer their Tickets to others, and may not knowingly give Tickets to others, for the purpose of circumventing the eligibility requirements or for allowing those others to re-sell such Tickets. All Tickets that have been transferred or resold in violation of these Official Rules shall be void and all individuals who re-sell, purchase, or receive Tickets in violation of these Official Rules shall be ineligible to participate in the Raffle or to win a Prize.

Odds. The odds of winning a Raffle depend on the number of Tickets purchased.

RELEASE OF LIABILITY. BY ENTERING INTO A RAFFLE, ALL ENTRANTS AGREE THAT THE CHARITY, DC UNITED, AUDI FIELD, AND THEIR RESPECTIVE PARENT COMPANIES, SUBSIDIARIES AND AFFILIATES, TOGETHER WITH THEIR OWNERS, PARTNERS, MEMBERS, EMPLOYEES, OFFICERS, DIRECTORS AND AGENTS (COLLECTIVELY, THE “RELEASED PARTIES”) WILL HAVE NO LIABILITY OR RESPONSIBILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) TO PERSONS, INCLUDING BODILY HARM, PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE, OR USE OF A PRIZE, ENTRY, OR PARTICIPATION IN A RAFFLE OR IN ANY RAFFLE-RELATED ACTIVITY, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY.  THE RELEASED PARTIES ARE NOT RESPONSIBLE IF ANY PRIZE CANNOT BE AWARDED DUE TO ACTS OF GOD, ACTS OF WAR, NATURAL DISASTERS, EPIDEMICS, WEATHER, OR TERRORISM.  Any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Raffle, and in no event will any participant be entitled to receive attorneys’ fees or any other legal costs.  The Released Parties are not responsible for any typographical or other error in Raffle materials, including Raffle advertising materials, the administration of Raffles or in the announcement of potential prize winner(s); tickets that are lost, stolen, damaged, illegible, given away or no longer in the purchaser’s possession; tickets that have been or may have been tampered with or re-sold in violation of these Official Rules; tickets or payments that are delayed, misdirected, or undelivered as a result of any failure or problem with the availability, functionality, operability or use of any network, server, ISP, website, computer, internet connection, hand-held mobile device or any other equipment or connection used in connection with a Raffle; and, any other errors of any kind, whether human or otherwise, related to a Raffle, including, without limitation, errors in identifying potential winners, errors in the administration of the Raffle or errors in any Raffle-related materials.

WITHOUT LIMITING THE FOREGOING, AND EXCEPT WHERE PROHIBITED BY LAW, EVERYTHING REGARDING THE RAFFLE, INCLUDING THE PRIZES, IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY.  CHECK LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.

General Conditions. Noncompliance with these rules may result in disqualification. Entry into a Raffle constitutes agreement to these Rules and agreement to be bound by all decisions of the Charity, acting in its sole discretion. All issues of interpretation are to be decided by the Charity, and are final and binding in all matters. Failure to enforce any provision of these Official Rules shall not constitute a waiver of that or any other provision by the Charity. The Charity reserves the right to modify these Official Rules at any time. The Charity reserves the right, in its sole discretion to cancel or suspend the Raffle should unauthorized human intervention or other causes corrupt the administration, security, fairness, integrity or proper operation of the Raffle.

Publicity Release. Except where prohibited by law, winners grant to the Charity (which grant will be confirmed in writing on request of Sponsor), its subsidiaries, affiliates, advertising and promotional agencies, suppliers, and those acting pursuant to its authority, the right and permission to print, publish, broadcast, and use, worldwide in any media now known or hereafter developed, including but not limited to the world wide web, at any time or times, each winner’s name, portrait, picture, voice, likeness, opinions and biographical information (including without limitation hometown and state) for advertising, trade, and promotional purposes (including the announcement of his or her name on television or radio broadcast) without additional consideration, compensation, permission, or notification.  Each winner shall execute all documents that the Charity may require in connection with this release.

Governing Law & Dispute Resolution. The Raffle and these Official Rules shall be subject to and governed by the laws of the District of Columbia. If a court of competent jurisdiction finds that any provision of these Official Rules, or their application to a particular person or circumstance, is invalid or unenforceable to any extent, then the remainder of these Official Rules shall remain enforceable to the fullest extent permitted by law. The venue for any cause of action arising out of a Raffle or these Official Rules shall be located in the District of Columbia.
